Copyright and DMCA Policy
Draft. This policy is under legal review and may change.
Last updated: [EFFECTIVE_DATE] Version 1.0
In short: Only post photos, videos and text that you created or have permission to use. If you believe something on CSI infringes your copyright, send a notice to our designated agent with the details listed below and we will act on it. If your content was removed by mistake, you can send a counter-notice. We close the accounts of repeat infringers. This summary is not part of the binding terms below.
1. Our policy
1.1. CSI respects intellectual property rights and expects Users to do the same. This Policy is part of the Terms of Service.
1.2. CSI responds to notices of alleged copyright infringement that comply with the US Digital Millennium Copyright Act ("DMCA"), and to notices under other applicable laws. We may remove or disable access to content that is claimed to infringe, and we may close the accounts of repeat infringers.
2. Designated agent
Send copyright notices to our designated agent:
[DMCA_AGENT] CSI ELITE SERVICES, LLC 604 Banyan Trl, Boca Raton, FL 33481, USA (mailing: PO Box 812332) Email: [DMCA_AGENT_EMAIL] Telephone: (833) 274-3425
3. How to send a notice of infringement
Your notice must be in writing and include:
(a) a physical or electronic signature of the copyright owner or a person authorised to act for them; (b) identification of the copyrighted work claimed to be infringed (or, if several works, a representative list); (c) identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example, the URL of the page); (d) your name, address, telephone number and email address; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law; and (f) a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the owner or authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that do not meet these requirements may not be acted on. Under the DMCA, anyone who knowingly and materially misrepresents that material is infringing may be liable for damages.
4. What we do
When we receive a valid notice, we will remove or disable access to the material promptly, and notify the User who posted it, including a copy of the notice where appropriate.
5. Counter-notice
5.1. If you believe your material was removed by mistake or misidentification, you may send a counter-notice to our designated agent that includes:
(a) your physical or electronic signature; (b) identification of the material that was removed and where it appeared before removal; (c) a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; (d) your name, address and telephone number; and (e) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which CSI may be found), and that you will accept service of process from the person who sent the original notice or their agent.
5.2. When we receive a valid counter-notice, we will send a copy to the person who sent the original notice. We will restore the material in 10 to 14 business days after receiving the counter-notice, unless we first receive notice that the complaining party has filed an action seeking a court order to restrain the User from engaging in infringing activity.
6. Repeat infringers
CSI will, in appropriate circumstances, close the accounts of Users who are repeat infringers.
