Terms of Sale (CSI Store)

In short: These terms cover products that CSI itself sells in its store, whether we ship them from our own stock, you pick them up, or a supplier ships them to you on our behalf. You pay through PayPal in US dollars. You can return most unused items within 14 days. Consumers in the European Union have a legal right to withdraw within 14 days and a model withdrawal form is at the end. Product warranties come from the manufacturer. Products labelled "Sold by" another business are sold by that pro, not by CSI, and these terms do not apply to them. This summary is not part of the binding terms below.
1. Scope
1.1. These Terms of Sale apply when you buy a product sold by CSI ELITE SERVICES, LLC ("CSI") in the CSI Store, and to gift cards bought from CSI (together with the Gift Card Terms). They are part of the Terms of Service. Words defined in the Terms of Service have the same meaning here.
1.2. They do not apply to products labelled "Sold by" a Pro. Those are Seller Sales, and the Seller's own terms and the law apply. CSI is not the seller of those products.
2. Products and sources
2.1. CSI sells products from two sources:
(a) CSI stock, held at CSI's stock locations (currently in the United States, and in other countries where shown), which we ship to you or which you collect from a pickup location; and (b) supplier-shipped products, which CSI sells to you and which our supplier ships to you directly on our behalf. These may ship from warehouses outside your country, including overseas, and usually take longer to arrive.
2.2. The product page and checkout show the source, shipping options and estimated delivery times for each item. You only see products and options available for your country.
2.3. Product photos and descriptions are as accurate as we can make them. Colours, finishes and sizes may vary slightly. If a product is materially different from its description, Section 9 applies.
3. Prices and currency
3.1. Prices are in US dollars and are charged in US dollars. Amounts shown in another currency are approximate and for information only.
3.2. Taxes are shown at checkout and on your invoice. Unless checkout says otherwise, customs duties, import taxes and brokerage fees charged by your country on delivery are your responsibility. [IMPORT_DUTY_HANDLING]
3.3. If a price is clearly wrong because of an error, we may cancel the order and refund you, even after we have confirmed it, unless the law of your country does not allow this.
4. Orders and contract
4.1. Your order is an offer to buy. You will review the items, prices, shipping and total before you pay. A contract forms when we send you an order confirmation email.
4.2. Your payment is taken through PayPal when you approve it. If we do not accept your order, or cannot fulfil it, we will refund the full amount you paid through PayPal.
4.3. We may limit quantities, refuse orders that appear to be fraudulent, for resale, or in breach of the Terms of Service, and cancel orders to destinations we cannot lawfully or practically serve.
4.4. A mixed order is split into separate shipments by source and location, each with its own shipping cost and timing.
5. Payment
5.1. Payment is by PayPal Checkout. You may apply gift card balance, store credit and coupons as the Gift Card Terms and the Rewards and Referral Terms allow.
5.2. PayPal's terms, including any buyer protection PayPal offers, apply to your payment.
6. Shipping, delivery and pickup
6.1. Shipping costs are calculated at checkout from live carrier or supplier rates. Delivery estimates come from the carrier or supplier and are not guaranteed. We will ship within the time stated at checkout or, if no time is stated, within 30 days. If we cannot, we will tell you, give you a new estimate, and let you cancel for a full refund.
6.2. You must give a complete and correct delivery address. Extra costs from an incorrect address are your responsibility.
6.3. Pickup. When your order is ready, we will notify you. Bring your order confirmation and identification. If you do not collect your order within [PICKUP_HOLD_DAYS] days after the notice, we may cancel it and refund you, less any amount the law allows us to keep.
6.4. Risk and title. For shipped orders, risk of loss and title pass to you when the products are delivered to the carrier, except that if you are a Consumer and the law of your country provides that risk passes on delivery to you (as in the European Union), risk passes when you or a person you name receive the products. For pickup orders, risk and title pass when you collect them.
6.5. If a parcel is lost or damaged in transit while CSI bears the risk, contact us within 30 days of the estimated delivery date and we will help with a carrier claim and replace or refund the item where we are responsible.
7. Returns (14 days)
7.1. You may return most products within 14 days after you receive them for a refund of the product price, if they are unused, in their original condition and packaging, with all parts and accessories.
7.2. To start a return, contact us at info@csieliteservices.com with your order number. We will tell you where to send the item. Supplier-shipped items may need to be returned to a different address, which may be outside your country. Please do not send items back without contacting us first.
7.3. Unless the item is faulty, damaged in transit or not what you ordered, you pay the cost of returning it, and original shipping charges are not refunded.
7.4. We will refund to your original payment method within 14 days after we receive and inspect the return. Any gift card or credit you used will be restored to your balance. Rewards points earned on a refunded item are reversed.
7.5. The following cannot be returned under this Section, unless faulty: products made or cut to your specifications; products that have been opened, mixed, tinted or partly used (such as sealants, coatings, paints and chemicals); sealed items that have been unsealed and cannot be returned for health, hygiene or safety reasons; and gift cards that have been redeemed.
7.6. This Section does not reduce your statutory rights, including the rights in Sections 8 and 9.
8. Right of withdrawal for Consumers in the European Union
8.1. If you are a Consumer living in the European Union, you have the right to withdraw from your contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the goods (or, for an order of several goods delivered separately, of the last good).
8.2. To exercise the right of withdrawal, you must inform us, CSI ELITE SERVICES, LLC, 604 Banyan Trl, Boca Raton, FL 33481, USA (mailing: PO Box 812332), email info@csieliteservices.com, telephone (833) 274-3425, of your decision to withdraw by an unequivocal statement (for example, a letter sent by post or an email). You may use the model withdrawal form in the Annex, but it is not obligatory. You may also use the withdrawal function in your account under "My orders" ("Withdraw from contract here"). To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.
8.3. Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us at the address we give you without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
8.4. The right of withdrawal does not apply to goods made to your specifications or clearly personalised, goods liable to deteriorate or expire rapidly, sealed goods unsealed after delivery that are not suitable for return for health protection or hygiene reasons, and goods that after delivery are, by their nature, inseparably mixed with other items.
9. Faulty or wrong products
9.1. If a product arrives damaged, faulty or different from what you ordered, contact us within 30 days of delivery (or within any longer period the law gives you) with your order number and photos. We will repair, replace or refund it, at our choice unless the law gives the choice to you, and pay reasonable return costs.
9.2. If you are a Consumer in the European Union, you also have the statutory legal guarantee for goods that do not conform to the contract, which lasts at least two years from delivery. In the United Arab Emirates, Qatar and Jordan, you have the rights given to consumers by local law. These rights are not affected by these terms.
10. Warranties
10.1. Any product warranty is given by the manufacturer, not by CSI. Where a manufacturer's warranty comes with a product, we will pass it on to you and, on request, help you contact the manufacturer.
10.2. EXCEPT AS STATED IN SECTIONS 9 AND 10.1, AND TO THE FULLEST EXTENT PERMITTED BY LAW, CSI SELLS PRODUCTS "AS IS" AND DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES AND COUNTRIES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS EXCLUSION MAY NOT APPLY TO YOU, AND IT DOES NOT AFFECT ANY STATUTORY RIGHT THAT CANNOT BE EXCLUDED.
11. Using products safely
You must read and follow the manufacturer's instructions, labels and safety warnings, and use products only for their intended purpose. Many home-improvement products (including chemicals, sealants, tools and electrical items) can cause injury or damage if misused. Installation that requires a licensed professional or a permit must be carried out accordingly.
12. Limitation of liability
Sections 21, 22 and 26 of the Terms of Service apply to purchases from the CSI Store. NOTHING IN THESE TERMS OF SALE LIMITS ANY LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY A DEFECTIVE PRODUCT TO THE EXTENT PRODUCT LIABILITY LAW DOES NOT ALLOW IT TO BE LIMITED.
