Do I Need a Permit for a Fence, Patio or Shed?

Fences, patios and sheds feel like simple weekend projects, but many cities and HOAs have rules for them. Building without approval can mean fines, a failed home sale, or being told to tear it out. Here is how to check.

Permits: what usually needs one

Rules depend on your city or county, but these often need a permit:

  • Fences, especially over a certain height or near a street, pool or property line.
  • Sheds over a certain size, or with electricity.
  • Patios and driveways that add hard surface, change drainage, or connect to the street.
  • Pergolas and covered patios attached to the house.
  • Anything with electrical, plumbing or gas work, such as outdoor kitchens.

HOA approval is separate

If you have an HOA, you usually need its approval as well as the city permit. HOAs often set fence styles and heights, paver colors, shed sizes and where things can go. Submit your plans and wait for written approval before work starts.

How to check

  1. Search your city or county website for "building permit" plus your project.
  2. Call the building department and describe the project. They will tell you what is needed.
  3. Read your HOA rules and submit an architectural request if required.
  4. Ask your pro. Licensed pros pull permits as part of the job and know the local rules.

Who pulls the permit?

In most cases the licensed contractor should pull the permit. Be wary if a contractor asks you to pull it in your name: it can make you responsible if the work fails inspection.
